Mazda Canada Inc. is the distributor of Mazda vehicles in Canada (referred to hereafter as Mazda). Mazda is a subsidiary of Mazda Motor Corporation in Hiroshima, Japan and was established in 1968. Our automotive products are distributed in Canada through a network of dealers authorized by Mazda, which are independently owned and operated businesses, which may have their own privacy policies and procedures. You should contact your Mazda dealer for information about their privacy practices.
Personal information is information about an identifiable individual. Personal information consisting of the name, title or business address or business telephone number of an employee is not considered personal information. Mazda collects personal information in a number of ways and through a number of different media. Typically, Mazda will collect personal information directly from an individual, or indirectly through a Mazda dealer or affiliated Mazda Company. Mazda may collect and use personal information in one, or more, of the following circumstances:
Personal information collected by Mazda typically consists of basic contact information: name, title, home address, e-mail address, and telephone and fax numbers. We may also collect demographic information such as a customer's gender; age and occupation, to better understand our customers and service their needs and for marketing purposes. Visitors to the Mazda web site are able to send e-mails to third parties from our web site. These messages may contain the user's full name, screen name and e-mail address, as well as additional personal information voluntarily included in the message.
Visitors to Mazda's website are not required to register or provide personal information to gain access. However, as Mazda's website evolves and becomes more interactive, and as the website becomes a repository for increasingly personalized customer information, Mazda may require visitors to register and provide user identification or authentication information. Such information will be required in order to secure and prevent unauthorized access to or theft of this information and for no other purposes.
Service data recorders (SDR) in your vehicle are capable of collecting and storing diagnostic information about your vehicle, which may constitute personal information. This may include information about the performance or status of various systems and modules in the vehicle, such as engine, throttle, steering or brake systems. Your Mazda dealer may access and collect this vehicle diagnostic information through a direct connection to your vehicle during the servicing process. The only circumstance in which this information may be disclosed to Mazda or Mazda Motor Corporation is in connection with providing service in relation to your vehicle, except as otherwise required by law. This data will enable Mazda Motor Corporation to provide its markets (distributors/dealers) with relevant information according to the data collected to support diagnosis and repair work at dealers.
Other modules in your vehicle, including event data recorders (EDR), are capable of collecting and storing data during a collision or near collision. The modules may record information about both the vehicle and the occupants, potentially including information such as:
Special equipment must be directly connected to the recording modules to access EDR information. Mazda does not access, collect, use or disclose EDR information without your consent, unless required under court order or elsewhere otherwise required by law.
Mazda may collect and use personal information in the circumstances described in paragraph 1 above. Information collected by Mazda is used only for the purpose identified at the time of its collection, as described in this policy, or for other purposes which are disclosed to you and to which you consent.
We may also use your personal information to investigate security breaches or cooperate with government authorities pursuant to a legal matter.
Personal information we collect may also be combined with information you have provided to Mazda through other sources such as over the telephone.

From time to time Mazda may engage unaffiliated third parties and their affiliates, agents and subcontractors ("Service Providers") to perform certain technological or administrative services for us. For example, a Service Provider may be asked to administer a contest or distribute email. We also may use a Service Provider to host and administer one or more of our Sites, process and store data, and fulfill similar technology-related functions on our behalf. In these circumstances, the personal information that the Service Provider receives is limited to only the personal information held by us that they need in order to render their service to us. The companies that are provided with the personal information are first required to sign an agreement that obligates them to keep the information confidential and secure and prohibits them from using it for unauthorized purposes.
We reserve the right to transfer any personal information we have about you in the event that we merge with or are acquired by a third party. We may also disclose your personal information to third parties if we have reason to believe that disclosing such information is necessary to: (i) conduct investigations of possible breaches of law; (ii) identify, contact, or bring legal action against someone who may be violating an agreement they have with us; or (iii) to protect our rights, safety or property. Lastly, we may disclose your personal information for any other purpose to which you consent.
When you visit a Mazda-owned website, we may collect information that is automatically sent to us by your web browser or your internet service provider. This information may include your domain name, and your numerical IP address. We may also collect other general information (such as the type of browser you use, which pages on our website you view, and the files you request). We use this information to better understand how visitors use our websites, and to improve our websites to better meet your needs. The amount of information that is sent by your web browser depends on the browser and settings you use. Please refer to the instructions provided by your browser if you want to learn more about what information it sends to websites you visit, or how you may change or restrict this.
To enhance your experience on our websites, we may use a feature on your Internet browser called a "cookie" and/or other similar devices such as web beacons. Cookies are small files that your web browser places on your computer's hard drive. They are used for a variety of reasons, such as tracking click streams, and for load balancing. Information tracked through these mechanisms may include, but is not limited to: (i) your IP address; (ii) the type of web browser and operating system being used; and (iii) the pages of the websites a user visits. By using cookies, we can deliver faster service, consistent, updated results, and a better experience on our websites. Most browsers give you the option to reject cookies. However, setting your browser to reject cookies generally hinders the browser's performance and will adversely affect your experience while using our websites.
Consistent with Canadian privacy law, Mazda retains your personal information only as long as necessary to fulfill the stated purpose(s) for its collection and use. Customer personal information collected for vehicle warranty administration is retained for ten years. Mazda reserves the rights to otherwise retain your personal information as may be required or permitted by law.
You have the right to access, verify and correct your personal information collected by Mazda. To help us keep your personal information current, contact the Mazda Privacy Officer at PRIVACY@MAZDA.CA. When requested, Mazda will suppress identifying information from current operational systems for the purpose of mailings or other communications except in the case of recalls or other similar events.
When you ask to access your personal information, Mazda will use reasonable efforts to comply with your request; however, in some cases we may not be able to allow you to access certain personal information in certain circumstances, for example if it contains personal information of other persons, or for legal reasons. In such cases, we will provide you with a reasonable explanation of why it is not possible to grant access to your personal information.
To the extent permitted by law, Mazda assumes no responsibility for verifying the ongoing accuracy of personal information. Once advised that personal information is inaccurate, Mazda will seek to amend the information and correct it with information provided by the customer.
Although we have taken reasonable and prudent measures to protect our websites, computer systems and any personal information that it has collected from unauthorized use, access, disclosure, misuse, alteration or destruction, no security measures can provide absolute protection. As a result, while we are committed to protecting your personal information, we cannot ensure or warrant the security of any information you provide to us.
Some or all of the personal information we collect may be stored or processed on servers located outside your jurisdiction of residence, including in the United States, whose data protection laws may differ from the jurisdiction in which you live. As a result, this information may be subject to access requests from governments, courts, or law enforcement in those jurisdictions according to laws in those jurisdictions. Subject to applicable laws in such other jurisdictions, we will use reasonable efforts to ensure that appropriate protections are in place to require the data processor in that country to maintain protections on the personal information that are equivalent to those that apply in Canada.
Canada's new anti-spam legislation (CASL) became effective July 1, 2014 and among other things will regulate the sending of commercial electronic messages (CEMs) by organizations such as Mazda. Mazda established an internal CASL Compliance Team to ensure Mazda is compliant with CASL. Mazda's approach to the issue of consent is to rely on implied consent for its existing and new customers based on its existing business relationship with its customers which is defined by the warranty coverage agreement. Implied consent applies for the length of the longest unlimited mileage warranty plus an additional two years.
What information we collect
The information we collect depends on the settings for your Connected Vehicle, and the Services you have access to and/or use.
Vehicle Data: When you purchase or lease a Connected Vehicle, the telematics system is active by default and transmits vehicle data, including driving behavior data (including the acceleration and speed of your Connected Vehicle, travel direction, and use of steering and braking functions) and vehicle health data (which includes Vehicle Identification Number (VIN); odometer, fuel level, and oil life readings; Diagnostic Trouble Codes (DTCs); and data from the Connected Vehicle’s OBD system, including engine coolant temperature, fuel injection volume, engine Rotation Per Minute (RPM), and the status of doors, hood, trunk, and hazard lights). If your Connected Vehicle has a Connected Services plan, we also collect geo-location coordinates of your Connected Vehicle’s latitude and longitude.
Connected Services and MyMazda: If you have an active Connected Services plan and/or use MyMazda, we collect information including your name, address, email, phone number, VIN, and any other information you choose to provide.
MyMazda Data: If you use the MyMazda app, we collect the location of your device, device type, device operating system, Internet Protocol (IP) address, unique identifier, type of browser, Internet service provider, phone number, and information about your use of MyMazda, including screen time, scrolling, specific actions and taps, reactions to alerts, the progress, completion and/or abandonment of in-application purchases, and crash reports.
How we use the information we collect
We use the information we collect to: analyze safety concerns and product trends, issue product recalls, provide support and service; to conduct research and development, analyze quality, for product improvement, and to improve, troubleshoot, and evaluate the use of our products and services; to provide our products and services to you, administer your accounts, to communicate with you, to allow us and our dealers to customize and conduct advertising, including by email, phone and direct mail, and for legal purposes such as protecting our interests.
We may use Location Data to provide you with a Vehicle Finder feature and other Services. We may use Driving Data and Vehicle Health Data to provide you with the status information of your Connected Vehicle, and to provide you with notifications when your Connected Vehicle is due for maintenance or service or when it reports a malfunction and other Services. We and our dealers may access Vehicle Data to provide you with servicing and respond to requests.
How we share the information we collect
If your MyMazda account has both a Primary and Secondary Users, the Primary User is able to see the name, app permissions and the complete remote request history initiated by Secondary Users. If you invite someone to be a Secondary user, you must have the Secondary User’s permission. We may send them an invitation that identifies you.
If you receive promotional emails from us, you may unsubscribe from them using the unsubscribe link. You may also opt-out of our use of your personal information for marketing by contacting us.
If you would like to disable the collection of Vehicle Data from your Connected Vehicle please contact our Customer Assistance Centre (see ‘Contact Us’ section below for details). You may have the ability to choose to limit the collection of Vehicle Data in a manner that allows you t reactivate it if you choose, in which case some limited Vehicle Data is still collected. You may also permanently halt the collection of Vehicle Data, in which case we will not be able to provide you with the Connected Services.
Application of this Policy
When you purchase or lease a Connected Vehicle and/or if you have an active Connected Services plan, your Connected Vehicle will transmit certain vehicle data to us automatically from time to time, including (“Vehicle Data”):
Additional collection of Information for the Services and MyMazda
In addition to our collection, use, sharing, and storing of Vehicle Data, if you have an active Connected Services plan and/or use MyMazda you will need to provide us with certain other information, which includes certain information about you or your Connected Vehicle that alone or in combination with other information could be used to identify you, e.g., name, address, phone number, and your Connected Vehicle’s Vehicle Identification Number (VIN).
For example, if you choose to subscribe to a Connected Services plan or register for a MyMazda account, you will be prompted in your MyMazda account to provide certain required Personal Information, which may include, but is not limited to, the following:
All Personal Information and other information that is required to enroll in the Services will be identified as a required field in the MyMazda, and you will not be able to complete enrollment without providing responses to all required fields. You may additionally provide other requested information that is optional but not required to use Services.
You can log-into your MyMazda App to review, correct, revise, or update certain of your Personal Information.
When you install or use the MyMazda app, in addition to the Vehicle Data and Personal Information described above, we may also collect (“MyMazda Data” and together with Vehicle Data, “Data”):
You can restrict our access to and collection of certain types of data using settings on your mobile device and/or settings in MyMazda. For example, you can disable location sharing on your device, if that feature is available on your device, and you can disable the collection of certain data for troubleshooting purposes in the MyMazda app settings.
To improve the stability and reliability of MyMazda, we use crash reports (currently through "Firebase Crashlytics", a service of Google). In case of an error of MyMazda, app and Device related data might be transferred to Google's servers, including without limitation device status information, device IDs, information relating to the physical location of a device, crash trace, log-files, device operational system and language information and information about how the app was used. The data may be used by Google for own business purposes (e.g. improve its services; see references below for details). We ask for your consent to enable these crash reports and you can withdraw your consent to them in the MyMazda app settings. You can revoke your consent at any time by deactivating the respective function in the app settings under analytics.

We continuously strive to protect the Data and Personal Information against loss and unauthorized access or use by maintaining and continually updating our formal security program, which employs physical, organizational and technical security practices to protect Data and Personal Information.
Even though we have taken steps to help protect the Personal Information in our control, you should know that we cannot fully eliminate security risks associated with Personal Information. No security measures can provide absolute protection. We cannot ensure or warrant the security of any information you provide to us.
Personal Information that we collect may be stored and processed in Canada or any other country in which we or our service providers maintain facilities, including in the United States and Japan. Personal Information processed and stored in another country may be subject to disclosure or access requests by the governments, courts or law enforcement or regulatory agencies in that country according to its laws.
By using our Services or by providing us with Personal Information, you consent to any such transfer of information outside of your country.

You have the right to access Personal Information we hold about you and to ask that your Personal Information be corrected, or updated. Please note that in some cases, we may not be able to allow you to access certain Personal Information in certain circumstances, for example if it contains Personal Information of other persons, or for legal reasons.
To help protect against fraudulent requests for access to your Personal Information, we may ask you for information to allow us to confirm that the person making the request is you or is authorized to access your information before granting access. For example, we may require you to verify your identity before you access your Personal Information.

If you sell or otherwise transfer your vehicle, it is your responsibility to delete all information (such as contacts, address look-ups, saved map addresses) from the vehicle’s system and contact us to transfer or cancel your account. This is important to help protect your account and your information, and that of the new owner. If you do not delete this information, it may remain on the vehicle’s system and may be accessible to future users of the vehicle. For example, we may continue to send reports or other information about the vehicle or account to the Primary User’s contact information currently on file with us, and the previous owner may be able to continue to use the services in respect of the Connected Vehicle. SUCH CONTINUED USE OF THE SERVICES BY THE PREVIOUS OWNER IS STRICTLY PROHIBITED. For instructions on how to delete information from your vehicle’s system, please refer to your vehicle owner’s manual. If you do not inform us of any sale or transfer of your vehicle, we are not responsible for any privacy related damages or claims you or anyone else may suffer. If you sell or transfer your Connected Vehicle, you must cease using any Services in respect of such vehicle. If a new owner opens an account in respect of a Connected Vehicle, any prior accounts in respect of such Connected Vehicle may be terminated.
